The Notice of Title Freeze is a unique, copyrighted legal document placed in the public records to effectively freeze property title from further recordings such as a deed or a mortgage without the property owners express, recorded consent.  Much like a consumer credit freeze blocks credit and loan applications from being processed, a Notice of Title Freeze resides in the public with clear restrictions and prohibitions of further recordings without the property owners express, recorded consent to deter fraudsters and protect property title from fraudulent conveyances.  Much like a credit freeze, a property with a Notice of Title Freeze in the public records will not proceed to a closing without the property owner first executing and recording a Title Unfreeze and Release.

Moat’s Notice of Title Freeze is similar to a credit freeze that protects a consumer against consumer fraud.  A credit freeze prohibits loan and credit applications up and until the consumer removes the freeze.  A Notice of Title Freeze effectively freezes a property owner’s title in the public records up to and until the owner releases the title freeze with a Notice of Title Unfreeze and Release.  A Notice of Title Freeze is simply stronger than title monitoring much like a credit freeze is stronger than credit monitoring.

Unfortunately, we live in a society that includes numerous scams and frauds involving identity theft. We have all probably received notice from a credit card company, bank or credit agency that our most sensitive data has been compromised. Some of us have had to close credit cards or bank accounts that became compromised with fraudulent transactions. It’s a painful process that leaves us feeling vulnerable and violated. Identity theft is real and despite our best efforts to keep our data secure it seems that the bad guys are always coming up with new ways to attack our identities and wreak havoc on our credit and our lives.

Over the last few years, the bad guys have come up with a new scam to attack our identity targeting our property and often the very homes we live in.  This identity scam begins in the public records where scammers can research owners of real property often looking for high-value properties with little or no mortgage burdens, second or vacation homes, or even vacant land.  The bad guys prepare a fraudulent deed with the actual owner’s name, forge the owner’s signature on the document, and record the document in the public records and just like that, the actual owner just conveyed their home or property in the public records to a thief.  To be clear, these conveyances are fraudulent and these deeds are not enforceable contracts when challenged by the rightful owner in a court of law as they are based in fraud, nonetheless, the impact can result in various forms of emotional and financial harm to the rightful property owner and certainly deliver clouds on the title that will need to be removed likely with a court action.  It is a stunning scam with many examples of how it is being played out noted on the News Page.

Moat Title Security offers an innovative and proactive defense to this scam.  As a client of Moat, you will have a Notice of Title Freeze prepared by Moat and placed in the public records to provide public notice that you have effectively frozen your property title and will not convey any interest in or otherwise encumber your property interests without first unfreezing your title by recording a Title Unfreeze and Release document.

Probably not. Check with your insurance agent but generally speaking the perils covered in a typical homeowner’s policy do not include losses from title identity theft and fraud against an owner’s title.
You do but that title policy only protects you up to the date of your closing for things like errors and omissions in the title leading up to your closing. That title policy does not provide coverage beyond the date of your closing.

It generally takes 1-2 weeks from the time your application is complete to the time your title is frozen and filed in the public records depending on the county where the documents are recorded.

You will be notified when the process of freezing your home title is complete and a copy of the recorded Notice of Title Freeze will be emailed to you from your local Moat Agent. A title report showing the Notice of Title Freeze document in the public records will also be sent to your email address on file with your Moat Agent.
